侵權行為法的立法宗旨研究
摘 要
隨著經濟社會的迅速發展，21世紀的侵權行為法也面臨著巨大的沖擊，通過對侵權行為法發展歷程以及立法宗旨的變遷的研究，我們可知，侵權行為法的立法宗旨正在從以補償為主向預防為主轉變，從對行為人的制裁為主向對受害人救濟為主轉變。由于無過錯責任原則的產生，責任保險制度以及社會保險制度的興起，傳統的侵權行為法遭遇著巨大的危機。面對危機，我們應該以1種積極的態度應對現實的挑戰，對侵權行為法進行反思，對人權的私法救濟、環境侵權、網絡侵權以及生物技術等領域帶來的侵權問題，提出相關建設性的意見，使2101世紀的侵權行為法的更加充實，并不斷得以完善。

Abstract
With the rapid development of the economy and the society, the tort law of 21st century is also facing the huge impact. Through legislation objective research of the tort law, we may know, the tort law of legislation objective is transforming from compensation primarily to prevention primarily, and from punishment primarily on behavior to relief primarily on the victim. Owing to the emergence of non-fault liability principle and the upsurge of liability insurance system and social insurance system, the traditional tort law is encountering the huge crisis. Confronting the crisis, we should face the challenge of the reality with a kind of positive manner, and propose the constructive composition on the infringement question related to private law relief of human right, environment infringement, internet infringement as well as the infringement that biological technology brings, so as to make the tort law of 21st century more substantial and complete unceasingly.
